On due consideration, the appeal is admitted for hearing.
Proposed substantive question of law should be :-
A. "Whether the grandson under the
Mitakshara School of Hindu law is entitled to joint
ownership in ancestral property by vitue of co-
parcenary status?
B. Whether both the Courts below have failed
to grant a relief of Joint Declaration of Title in light of
the settled provisions of the Order 7 Rule 7 of the
C.P.C?"
Issue notice to the respondents.
P.F. to be paid as per rules.
Also heard I.A. No.1/2022, application for grant of ad-interim relief.
Issue notice on I.A. No.1/2022 to the respondents.
List this case in the 1st week of August, 2022.
Meanwhile, purely as an interim measure, it is directed that both the parties shall maintain the status quo of the civil suit property till the next date of hearing.
