2. Also heard on application for grant of leave to appeal under Section 378(3) of the Code of Criminal Procedure, 1973 against the judgment of acquittal dated 05.08.2021 in Sessions Case No. 28/2020 passed by learned Sessions Judge, Jashpur, District- Jashpur (C.G.).
3. After due consideration of the submission and taking into consideration the evidence present in the case, we are of the considered view that this application should be allowed.
4. Leave is granted for filing acquittal appeal.
5. Registry is directed to register the present CRMP as acquittal appeal and list this case for hearing on admission.
6. Accordingly, the instant CRMP stands disposed of.
