1) The present appeal i.e. CRA No.94 of 2022 and previously filed

appeal CRA No.1526 of 2021 are arising out of the same

judgment of conviction and order of sentence dated 15.11.2021

passed by the Additional Sessions Judge (F.T.C.), Bemetara,

District Bemetara, C.G. in Sessions Trial No.29/2018. Previously

filed appeal i.e. CRA No.1526 of 2021 has been preferred by the

same appellant namely Bhuwan Sahu through his counsel. Since

two appeals against the same judgment of conviction and order

of sentence are not maintainable, in the facts and circumstances

of the case, the present appeal i.e. CRA No. 94 of 2022 is

dismissed as not maintainable.

CRA No.1526 of 2021

2) Heard on admission.

3) The appeal CRA No.1526 of 2021 is admitted for hearing.

4) State counsel is directed to file reply to I.A. No.01/2021,

application for suspension of sentence and grant of bail.

5) List CRA No.1526 of 2021 after two weeks.
