Counsel for the petitioner submits that he does not want to press I.A. No.2/2017, an application for condonation of delay under Section 5 read with Section 14 of the Limitation Act.
After perusal of the judgment of the Court below and other evidence adduced by the parties, I am of the view that it is a fit case where leave should be granted.
Accordingly, leave is granted to file acquittal appeal. Registry is directed to register this Cr.M.P. as acquittal appeal. Accordingly, the instant petition is disposed off.
