1. Heard on admission.
2. Perused the impugned judgment and gone through the statements of witnesses.
3. After perusal of statements of Hemu Nishad (PW-3) and Shivkumar Prasad (PW-4), I am of the view that it is a fit case in which leave should be granted for filing acquittal appeal. The application is accordingly allowed and leave is granted to file acquittal appeal.
4. Let the appeal filed by the State be registered as an acquittal appeal and be listed for further orders.
5. The present CRMP is accordingly disposed of.
