Shri Lalit Jangde, Dy. Govt. Advocate for the State. Heard on IA No.1/21, application for suspension of fine amount imposed upon the appellants vide judgment of conviction and order of sentence dated 13.8.2019 passed in S.T. No.108 of 2015 by learned Sessions Judge, Kondagaon, District- Kondagaon (CG).

Learned counsel for appellants would submit that the

appellants are poor villagers and they find it extremely difficult to arrange huge sum of money by way of fine.

On the other hand, learned counsel for the State submits that as per the judgment of learned trial Court, a part of the fine amount is required to be paid to the legal representatives of the deceased.

Taking into consideration the submissions made by learned counsel for the respective parties, we are inclined to allow the application.

The application is accordingly allowed and it is directed that on each of the appellant depositing Rs.10,000/- before the trial Court within 45 days, there shall be suspension of the judgment to the extent of deposition of fine amount also.

The amount so deposited by the appellants may be disbursed to the legal representatives of the deceased.
