Heard on I.A.No.2/19, application for suspension of sentence and grant of bail.

The appellant has been convicted under the impugned judgment of conviction and order of sentence dated 24/07/2007 passed by the Sessions Judge, South Bastar, Dantewada, Chhattisgarh in Sessions Trial No.36/05.

Learned counsel for the appellant would submit that the appellant has been convicted for life imprisonment and by now, he has undergone 22 years of jail sentence and the appeal has not been heard finally.

On the other hand, learned State counsel would submit that in this case, the appeal has been filed only in the year 2019.

Considering the submission of learned counsel for the parties, particularly taking into consideration that the appellant has undergone 22 years of jail sentence, we are inclined to allow the application (I.A.No.2/19). The jail sentence awarded to the appellant shall be suspended with immediate effect and the appellant be released on furnishing a personal bond in the sum of Rs.10,000/-. The appellant will have to remain present before the Trial Court on a date to be fixed by the Trial Court at the time of accepting bail bonds.

This appeal be listed for final hearing in the next week.
