Learned counsel for the petitioner would submit that before registration of
FIR, proceedings as provided by the Hon'ble Supreme Court in the matter of
Arnesh Kumar Vs. State of Bihar reported in 2014 (8) SCC 273 have not been
followed by the State. Therefore, registration of FIR is prima facie illegal. The issue
requires to be considered by this Court.
The petition is admitted for hearing.
State is directed to file reply whether compliance of proceedings in the
above said judgment has been done or not before the next date of hearing and
State will also produce the case diary before this Court.
Issue notice to the respondent by ordinary mode as well as by registered
post. Process fee be paid within one week.
List this case in the week commencing 16th of August, 2021.
