It is submitted that the respondent No.4 was elected Up Sarpunch of Gram
Panchayat-Chirguda. A no confidence motion was brought in the meeting held on
23.9.2021. The no confidence motion was carried against respondent No.4 and she was
removed from the post of Sarpunch Gram Panchayat-Chirguda. Respondent No.4
preferred an appeal before Collector (respondent No.3) which was dismissed by order
dated 28.10.2021 (Annexure-P/7). Respondent No.4 then preferred revision before
respondent No.2(Commissioner). The Commissioner has by the impugned order
entertained the revision petition and passed order directing to maintain status-quo for a
period of 90 days.
It is submitted by the counsel for petitioner that the Commissioner (respondent
No.2) has illegally entertained the revision petition. Section 21(4) of the Panchayat Raj
Adhiniyam, 1993, provides for appeal before Collector only and the order passed by the
Collector is the final order, therefore, there being no provision for filing revision present in
the enactment. The impugned order is liable to be quashed.
Reliance has been placed on the judgment of M.P. High Court in the case of
Ramnath Kaushik Vs. State of M.P. and Ors., reported in (1999) 2 MPLJ 67.
Therefore, it is submitted that interim relief be granted.
Learned State counsel opposes the submissions made by counsel for petitioner. It
is submitted that in the case of Gandhi Lal Patel Vs. State of M.P., reported in (1999)2
JBP L.J. 109. It has been held by the M.P. High Court that the revision before
Commissioner is maintainable.
After considering on the submissions, it is ordered that the proceeding initiated
before respondent No.2 shall remain stayed until the next date of hearing.
Notice be issued to respondent No.4. PF as per rules.
List this case after four weeks.
