Heard on I.A. No.1/2020, an application under Order 41 Rule 5 read with Section 151 of the Code of Civil Procedure.
Looking to the facts and circumstances of the case, particularly considering the fact that this appeal has been already admitted for final hearing and according to the judgment of learned Trial Court, the appellant is in possession of a suit property, therefore, the said application is allowed.
It is directed that the execution of the impugned judgment and decree dated 13.11.2019 passed by the Additional District Judge (F.T.C) Korba, District: Korba (C.G.) passed in Civil Suit No.7-A/2015 shall remain stayed until further orders, subject to appellant depositing a sum of Rs.1,00,000/-, as a security to the satisfaction of the concerned Trial Court.
Post this matter for final hearing in its due course.
