The Court: In a partition and administration suit the plaintiff had

taken out this application inter alia for injunction wherein as far back as on

25th September, 2023 the parties were directed to maintain status quo as of

that date in respect of the immovable property situated at 6A, Nandolal Bose

Lane, Kolkata-700003. This order on being extended from time to time is still

in subsistence. Subsequently, by an order dated 4th October, 2023 a Special

Officer was appointed to inventorise the said immovable property and

ascertain as to whom amongst the parties are in possession and occupation

of different portions thereof. The learned special officer had inspected the

said premises and had filed a report. No exception was taken in respect of

the said report. It is therefore apparent that no change in situation so far as

the said immovable property is concerned has taken place for more than two

and half years from the passing of the initial order.

In the aforesaid facts and circumstances, the said order directing the

parties to maintain status quo read with the report of the special officer is

confirmed and shall continue till the passing of any decree or part decree

relating to the said immovable property.

The report of the learned special officer shall be sent to the

department in a sealed envelope to be kept with the records of the suit.

Application being GA/1/2023 stands disposed of.
