The Court: APO/92/2025 is an appeal directed against a judgment

and order dated September 5, 2024, whereby the application of the

respondent herein, under Section 535 of the Companies Act, 1956, for a

direction on the Official Liquidator to disclaim a property belonging to the

respondent herein, was allowed.

The company (in liquidation) through the Official Liquidator

applied for recalling of the aforesaid order dated September 5, 2024. That

application was dismissed by the learned Single Judge by a judgment and

order dated July 18, 2025. APOT/231/2025 has been filed by a contributory

to the company (in liquidation) against such order of dismissal.

We have heard Mr. Bachawat, learned Senior Counsel appearing

for the appellant in both the appeals for quite some time. There is no further

time today.

This Bench will not be available for some time since it will be on

Circuit.

List these appeals once again on February 16, 2026.

The interim order that is subsisting in APO/92/2025 shall

continue till the end of February, 2026 or until further orders, whichever is

earlier.

Leave is granted to the appellant to file the paper-books in the

department in course of this week.
