BEFORE:
The Hon'ble JUSTICE ARINDAM MUKHERJEE

Date: 20th January, 2026 Appearance:

Ms. Priyanka Agarwal, Adv.

Ms. Vedika Sureka, Adv.

Mr. Pawan Kumar Agarwal, Adv.

For plaintiff Mr. Andolan Sarkar, Adv.

Mr. Barnik Ghosh, Adv.

For defendants

The Court: There are two applications, one GA/2/2025 filed

by the plaintiff for judgment upon admission under the provisions

of Order XII Rule 6 of the Code of Civil Procedure, 1908 (in short

CPC) and the other GA/3/2025 filed by the defendants for rejection

of the plaint inter alia under the provisions of Order VII Rule 11 of

CPC. The plaintiff says that the plaintiff is not willing to file any

affidavit-in-reply to her application under Order XII Rule 6 of CPC.

Affidavit-in-opposition is already on record so the pleadings in such

application are complete.

So far as the pleadings in respect of the application under

Order VII Rule 11, the same has to be also treated to be complete as

the plaintiff does not intend to file any affidavit-in-opposition but

will only make legal submission to rebut the claim of the

defendants.

Order VII Rule 11 application is taken up for consideration.

However, the arguments made therein on behalf of the defendants

could not be concluded.

Let GA/3/2025 appear in the list on 29th January, 2026

under the heading "Chamber Application for Final Disposal" and

GA/2/2025 shall also appear on 29th January, 2026 in the list

under the heading "Adjourned Motion".

(ARINDAM MUKHERJEE, J.)
