The Court : GA 2 of 2025 has been filed by the respondent no.6 in

WPO 1150 of 2022, seeking deletion/striking out of its name from the array

of respondents in the writ petition as also a direction upon the petitioner to

accept a demand draft for a sum of Rs.18,252/- towards full and final

settlement of the writ petitioner's claim against the respondent no.6 as

prayed for by the writ petitioner.

The respondent customs authorities are represented.

Attention of this Court is drawn by the parties (i.e. petitioner and the

respondent no.6) to the letter dated June 30, 2025 (Annexure 'B' at page 12

of GA 2 of 2025) written on behalf of the respondent no.6 to the learned

Advocate for the respondent no.6 as well as the e-mails dated February 24,

2024 and February 26, 2024 at page 13 of the writ petition to submit that

the writ petitioner and the respondent no.6 have agreed to settle the

dispute out of Court upon the respondent no.6 paying a sum of Rs.18,252/-

to the writ petitioner.

Learned Advocate appearing for the respondent no.6 submits that the

respondent no.6 has already made over to the writ petitioner a demand draft

bearing no.338228 dated November 11, 2025 for a sum of Rs.18,252/-

drawn in favour of the writ petitioner. A receipted copy of the said demand

draft made over to the petitioner by the respondent no.6 has been handed

up to Court. The same is taken on record.

The writ petitioner has no objection to the deletion of the name of the

respondent no.6 i.e. M/s. Central Warehousing Corporation from the array

of respondents. Accordingly, let the name of M/s. Central Warehousing

Corporation be struck off from the array of parties/respondents in the writ

petition.

It is also pointed out that by an earlier order dated July 8, 2022, the

name of the respondent no.5 had also been directed to be struck off.

However, it appears that the cause title of the writ petition has not yet been

appropriately amended.

The department shall take appropriate steps to amend the cause title

of the writ petition in accordance with this order as well as the order dated

July 8, 2022 by deleting the names of respondent nos.5 and 6.

GA 2 of 2025 stands disposed of.

Let WPO 1150 of 2022 be listed for hearing on February 18, 2026.
