          The Court: Supplementary affidavit filed by the petitioner in Court

is taken on record.

          It appears that the Recruitment Rules that has been challenged in

the writ petition, has been repealed and a new Recruitment Rule has been

introduced during pendency of this writ petition. The petitioner seeks to

challenge the new Recruitment Rule in this writ petition.

           Since the introduction of the new Recruitment Rule is a subsequent

event, to avoid multiplicity of proceedings, the amendment application stands

allowed.

           Accordingly, IA No.GA/4/2026 stands allowed.

           Let the Department carry out the necessary amendments within

seven days from date in terms of paragraph 4 of the supplementary affidavit.

           Let copy of the amended writ petition be served by the petitioner

upon the learned Advocate appearing for the respondents within ten days

from date. The respondents will be at liberty to file affidavit-in-opposition

within two weeks thereafter. The petitioner will also be at liberty to file reply

within one week thereafter.

List this matter after four weeks.

Appointment to the post of Assistant Engineer, Civil, Electrical and

Mechanical in terms of the new Recruitment Rules, shall abide by the result of

the writ petition.
