The Court:- Two affidavits of service filed in Court today are taken

on record.

It is submitted by the applicants in this application for grant, the

Bank as also Ashoke Kr. Bose (brother) of the deceased that the Bank has

paid all the arrears up to January 2026 in terms of the previous order dated

28th January, 2026 as corrected by the order dated 30 th January, 2026.

There is, as such, no outstanding due or arrears of rent receivable by the

widow and daughter of Amitava Bose, deceased abovenamed and his brother

Ashoke Kr. Bose. The only outstanding due is the payment of monthly lease

rental.

On a perusal of the agreement, it appears that the rent is required

to be paid within 10th of each subsequent month for the occupancy. In that

view of the matter, the rent for the month of February, 2026 will fall due by

10th of March, 2026.

The Bank is directed to bifurcate the rent receivable from HDFC

Bank Limited and pay one half portion thereof jointly to the petitioners and

the other half to Ashoke Kr. Bose in accordance with law.

The Bank shall furnish TDS certificate for the payments made to

the widow and daughter of Amitava Bose, the deceased and that to Ashoke

Kr. Bose.

The Bank shall continue to pay the rent as applicable from time to

time in the manner as indicated hereinabove.

Nothing further remains to be adjudicated in this application. The

application is, accordingly, disposed of.
