The Court:- Mr. Sen, the Learned Senior Counsel for the Plaintiff

submitted that an application is filed for withdrawal of the suit which has been

heard before this Court since long. The Defendants did not raise any objection

right now for passing order of withdrawal of the suit. This apart written

statement is yet to be filed on behalf of the Defendants. They have no vested

right as yet in the suit though expressed an intention to make counter claim but

there is no claim as yet as the written statement has not been filed.

Let the suit be withdrawn and stand dismissed accordingly along with all

the applications.

All interim orders stand vacated.
