             The Court: On the prayer of Mr. Vipul Kundalia, learned Senior

Advocate appearing for the Customs Authority, time to file affidavit stands

extended till today. Affidavit filed in Court today is taken on record. Copy

has been served on Mr. Ratul Das, learned Advocate appearing for the

plaintiff.

             The plaintiff shall consider the affidavit.

             The order dated March 10, 2026 shows that further directions,

if required to be passed, those will be against the defendant.

             Defendant is not represented today, though he had already been

represented previously through his Advocate on Record, Mr. Soumya

Basu, learned Advocate.

         In view of the above, the plaintiff shall serve a notice along with

a copy of today's order upon the defendant and Mr. Soumya Basu, learned

Advocate on Record for the defendant.

         The defendant is directed to be personally present in Court on

the next day in view of his long absence in the matter and more so, there

has already been a direction by a Co-ordinate Bench to deposit a sum of

Rs.80,00,000/- by the defendant to the Registrar, Original Side but

record shows deposit has not yet been made.

         It is made clear that if the defendant is not represented and also

does not appear personally on the next day, this Court may proceed to

consider issuance of warrant of arrest against the defendant to ensure his

presence before this Court.

         The matter shall appear under the heading "New Motion" on

May 6, 2026.

         The plaintiff shall also file an affidavit of service on the next day.
