The Court:- GA/5/2025 is an application praying for dismissal of
PLA/96/2017.
Mr. Mukherjee, the Learned Counsel for Caveatrix seeks liberty to
withdraw the application.
Let GA/5/2025 be dismissed as withdrawn.
Caveat has been filed by the daughter of the Testatrix supported by
affidavit. Considering the caveatable interest, let the caveat be accepted.
The suit may be converted into testamentary suit being the contentious
cause.
The department is directed to do the needful.
The suit will appear in the list on 18th May, 2026 for framing of issue.
Discovery, inspection, admission, denial as well as disclosure of
documents shall be complete in the meantime.
Though withdrawn, the Caveatrix is at liberty to file appropriate
application for protection of the properties.
