          The Court : Mr. Jayanta Sengupta, learned Advocate appears for

the plaintiff.

          None appears for the defendants.

          This is an application, inter alia, praying for judgment upon

admission. The suit is for price of goods sold and delivered.

          Mr. Sengupta submits that only the defendant no. 1 has filed its

affidavit in opposition to which the plaintiff has filed affidavit in reply. Rest

of the defendants chose neither to be represented nor to file affidavit in

opposition, despite notice.

          Mr. Sengupta further submits that the plaintiff has gathered

information that the defendant no.1 has undergone in an insolvency

proceeding under IBC. Resolution Professional has been appointed, who

must step into the shoe of the defendant no.1 in this proceeding.

         In such circumstance, in the event the plaintiff receives complete

information, then the plaintiff shall serve a notice upon the concerned

Resolution Professional and also upon the defendant no.1 at its address

mentioned in the plaint and shall file an affidavit of service on the next

day. On the next day the plaintiff also shall apprise this Court with the

detailed information with regard to the present status of the defendant

no.1.

         This application shall appear on February 19, 2026 under the

heading "Adjourned Motion".

         The plaintiff shall serve a copy of today's order upon the non-

appearing defendants also once again and file affidavit of service.
