Delay in filing the appeal if any is condoned in view of the fact that the parties have amicably settled the dispute out of court.

This miscellancous appeal has been preferred against the award dated 4h April, 2017 passed in MAC case No. 39 of 2014. By the said order learned Tribunal below awarded a sum of Rs. 2,00,000/- in favour af the claimant no. 1, wife of the victim, Rs. 2,00,.000/- in favour of claimant nos. 2, minor son of the victim, Rs. 7O,000/~- in favour claimant no. 3, mother of the victim and Rs.

30,000 /- in favour of claimant no. 4, father of the victim. The claimants subrut

"Company. During pendency of the present appeal by consent of the parties it has been agreed that the Insurance Company shall pay further sum of Ks. 556,000 /- to the claimants /appellants towards full and final settlement.

The Insurance Company is accordingly directed to deposit Rs. 5,50, 000 /- to the office ef the learned Registrar General, High Court at Calcutta Within a period of one week after the Puja Vacation. On such deposit, the learned Registrar General shall disburse the said amount to the claimants in the mode and manner as indicated in the impugned judgment dated 4th April, 2017 on proper identification.

The LCR, if any, be returned to the connerned Court with a copy of this Award, Concerned officials of the Registry is directed to take appropriate steps at once.

With the above observations and directions, the appeal is disposed of.
