        has referred to the two judgments of the Hon'ble

        Supreme Court and a co-ordinate Bench of this court

        respectively.     Let copies of the same be taken on

        record.    Regarding   the   same,   Mr. Khan,     learned

        advocate for the private respondent as well as Mr. Deb

        Roy, learned Additional Government Pleader appearing

        for the State respondents, have objections to raise,

        that the judgments as referred to by the petitioner in

        this case would not be applicable.

On the prayer of the petitioner, it is directed

to let the interim order passed earlier in this case be

extended till the date of pronouncing of judgement.
