The Court: Mr. Krishnaraj Thaker, learned Counsel, is appearing

for the plaintiffs and Mr. Arik Banerjee, learned Counsel, is appearing for

the defendant.

Counsel for the defendant intends to move the application filed by

the defendant being GA/1/2021 and GA/5/2022.

Counsel for the plaintiffs raised objection and submitted that the

defendant had filed an application under Section 10 of the Code of Civil

Procedure which was heard by the previous bench and the matter is

reserved for judgment. He prays that unless the judgment is delivered in

GA/4/2022 no further interlocutory application can be taken up for

hearing.

Learned Counsel for the defendant also relied upon the order

dated 24th January, 2023 wherein this Court has passed an order that as

the judgment is reserved in connection with GA/4/2022, the other

applications for the time being be directed to go out of the list with liberty to

mention.

Counsel for the plaintiffs submits that only the Court for the time

being has directed the matters to go out of the list with liberty to mention.

Now the plaintiffs have mentioned the matters so as to enable the plaintiffs

to move their other applications for early disposal.

Heard the learned Counsel for the respective parties.

This Court finds that the plaintiffs have filed applications being

GA/1/2021 and GA/5/2022 in the year 2021 and 2022 respectively and

since then the said applications are pending for adjudication.

List this matter on 18th November, 2024 at 3:00 pm for hearing of

GA/1/2021 and GA/5/2022.
