The Court : Mr. Rajarshi Dutta, learned counsel is appearing for the

plaintiff.

Mr. Debdut Mukherjuee, learned counsel is appearing for the defendant.

Counsel for the parties submit that item 43, being CS 176 of 2022 and

item 44 being, CS 176 of 2022 are also connected with item no.9, that is, CS

177 of 2022. In both the suits the plaintiff has filed an application for summary

judgment and the defendant has filed an application for rejection of the plaint.

In CS 177 of 2022, the defendant has also filed an application for extension of

time to file written statement.

This Court finds that all the two suits are inter-connected one and as

such this Court is of the view that both the suits and interlocutory applications

shall be taken up for hearing together.

In view of the above, CS 176 of 2022 and CS 177 of 2022 along with all

connected applications be listed on 13 th November, 2024 under the heading

"Adjourned".

In the meantime, if the plaintiff intends to file affidavit-in-opposition in

connection with GA 3 of 2024 in CS 177 of 2022, plaintiff may file affidavit-in-

opposition by 8th October, 2024. Reply, if any, be filed by 7 th November, 2024.

List the matter on 13th November, 2024.
