        The Court:- In terms of the Order dated 11th December, 2023 the

judgment-debtor Mr. Vijendra Kumar Goel was produced under arrest before

this Court by Deputy Sheriff of Kolkata. On production he was released from the

custody subject to conditions that he will not leave the jurisdiction of this Court

without prior intimation to the local Police Station namely, Barabazar Police

Station; secondly, he should deposit a sum of Rs.3 Lakh within 48 hours to the

learned Registrar, Original Side and thirdly, the judgment-debtor on dock

undertook to deposit 50% of the principal decretal amount on or before 1st

January, 2024. This Court noted that the balance amount of half of the decretal

amount less Rs.3 Lakh, should be deposited before the learned Registrar,

Original Side on or before 4th January, 2024. It was clarified that in case of

failure of any of the conditions, release would stand cancelled and he should be

re-arrested.

        From the Report of the Assistant Registrar, Cash Department, Original

Side dated 5th January, 2024 it appears that the sum of Rs.3 Lakh had already

been deposited by the judgment-debtor on 13.12.2023 but till 4 P.M. on

5.1.2024

the rest of the amount, as directed, had not been deposited.

Therefore, release of the judgment-debtor stands cancelled. Let him be re-

arrested and produced before this Court on 24th June, 2024. Copy of this order

may be sent by the Learned Registrar, Original Side, to the Deputy Sheriff and

to the Officer-in-Charge of the Barabazar Police Station for re-arrest of the

judgment-debtor Mr. Vijendra Kumar Goel and for taking consequential steps.

The matter will appear in the list on 24th June, 2024.

Affidavit of service filed in Court be kept in records.
