The Court: Affidavit of service filed in Court today be taken on
record.
Mr. Rohan Raj, learned Advocate enters appearance on behalf of
the alleged contemnor. He, however, submits that the respondent has
preferred an appeal from the judgment and order dated 26th June, 2023
and, as such, prays for an accommodation.
Mr. Pandey, learned Advocate representing the applicant
submits that only after the contempt application was served on the alleged
contemnor, the alleged contemnor started taking steps in the appeal.
According to him, appeal is out of time and barred by limitation. He insists
that the matter be taken up for consideration.
Having heard learned Advocates appearing for the respective
parties and taking note of the fact that an appeal has been filed challenging
the judgment and order dated 26th June, 2023, let this matter stand
adjourned and appear in the monthly list of March, 2024.
