The Court: Learned Counsel for the decree-holder has submitted that the

judgment-debtor has paid the share of Municipal taxes and surcharges to the

KMC which is the actual entitlement of the decree-holder and by virtue of the

compromise decree the bank cannot pay the entitlement of the decree-holder to

the KMC.

Learned Counsel for the judgement-debtor has submitted that the amount

was actually the statutory dues of the bank and the bank in its wisdom paid the

amount to the KMC subject to right and liabilities of the bank.

Learned Counsel for the decree-holder has sought for an accommodation

for replying on the points raised by learned Counsel of the judgment-debtor.
