A challenge has been shown to the maintainability of
the writ petition before this Court. Admittedly, the
petitioner is a retired employee of Eastern Railways.
This Court is of the view that the appropriate
Tribunal is the Court at first instance relying on the Apex
Court's judgment in L. Chandra Kumar vs. Union of India
& Ors. reported in (1997) 3 SCC 361.
This Court has no jurisdiction to receive, try and
entertain the present writ petition.
Accordingly, W.P.A. 22445 of 2023 is dismissed.
The petitioner will be at liberty to approach the
appropriate forum, if so advised.
It is made clear that this Court has not gone into the
merits of the writ petition.
All parties shall act on the server copy of this order
duly downloaded from the official website of this Court.
