Pursuant to the leave granted by this Court on

September 14, 2023 the respondent no.10 has affirmed

a counter affidavit on September 20, 2023. The same is

filed in Court today and is taken on record.

Copy of such affidavit shall be served upon Mr.

Saibal Acharya, learned advocate appearing for the

respondent nos. 8 and 9. A copy has already been

received by Mr. Gourav Das, learned advocate for the

petitioners.

The Primary School Council, the respondent nos.

8 and 9 has already fixed the notional benefit in

favour of the petitioner and a communication has

also been made over to this Court today in this

regard dated September 20, 2023, issued by the

Secretary of the relevant Primary School Council, is taken

on record.

The order of injunction passed against the

respondent no.10 shall continue until disposal of the

writ petition.

Hearing of the writ petition stands concluded and

the judgment stands reserved.

The petitioner, respondent nos. 8 and 9 and the

respondent no.10 shall be at liberty to file their

respective written notes in the writ petition including

the observation made by this Court in its order dated

August 16, 2023 on or before October 5, 2023.

ACO The writ petition shall appear under the heading

"To Be Mentioned" on October 6, 2023 only for the

purpose of filing written notes by the parties, as directed

herein.
