This appeal has been preferred challenging the

order and judgment of conviction passed by the learned

Special Judge (Additional Sessions Judge, 4 th Court,

Alipore) under NDPS Act on 28.07.2023, whereby the

appellant/accused was found guilty of committing offence

under section 21(B) of the NDPS Act and sentenced to

suffer rigorous imprisonment for six (6) years and to pay a

fine of Rs.50,000/-, in default, to suffer further

imprisonment for one (1) year.

I have gone through the judgment, and there is a

scope of re-appreciation of evidence.

The appeal is admitted.

Issue usual notices.

Trial Court Record be called for.

After arrival of the Lower Court Record, if it is

found, otherwise in order, the formal paper book shall be

prepared within six weeks thereafter.

Liberty is given to file bail application.

Realization of fine amount be stayed in the

meantime.
