The petitioner's prayer in appeal was affirmed by the

judgment and order dated 26.07.2022 passed by the learned

Additional Sessions Judge, 4th Court, Howrah in Criminal Appeal

No.5 of 2006 wherein the learned appellate court was pleased to

dismiss the appeal in connection with Bagnan P.S. Case No.50

dated 10.06.1995.

Learned advocate appearing for the petitioner submits

that the other accused persons who have been convicted and

sentenced has preferred a separate revisional application being CRR

3655 of 2022.

Having considered the submissions so advanced by the

petitioner and on perusal of the order-sheet, I direct that the

present revisional application be heard along with CRR 3655 of

2022. So far as the present petitioner is concerned, there shall be

stay of the judgment and order dated 26.07.2022 passed in

Criminal Appeal No.5 of 2006 till 22nd December, 2023.

Lower Court Records both of the trial court and the

appellate court be placed before this Court while considering the

revisional applications.

In the meantime, petitioner is directed to serve a copy of

the revisional application upon the opposite party no.1/State

through the Office of the learned Public Prosecutor, High Court,

Calcutta and upon the opposite party no.2 by speed post with

acknowledgement due and file affidavit-of-service on the next date

fixed for hearing.

List the revisional application under the heading

"Contested Application" in the monthly list of December, 2023.

All parties shall act on the server copy of this order duly

downloaded from the official website of this Court.
