Citation : 2023 Latest Caselaw 7346 Cal
Judgement Date : 19 October, 2023

Calcutta High Court (Appellete Side)
Prakash Chand Vaidya & Ors vs Shakil Ahmed on 19 October, 2023
19.10.2023
ct. 236
sk,sl. 8
                               S.A.135 of 2019

Prakash Chand Vaidya & Ors.-vs-Shakil Ahmed
.

Mr. Bhaskar Ghosh, Ld. Sr. Adv. Mr. Rwitendra Banerjee Mr. Siddhartha Paul Mr. Janardhan Mondal ...for the appellants.

Mr. Dipta Dipak Banerjee Mr. Joydeep Chatterjee Mr. Diwakar Pathak Ms. Nilakshmi Ghosh ........for the respondent.

1. Shakil Ahmed was the original appellant

before the court at whose instance second

appeal being SA 135 of 2019 was admitted.

During pendency of the appeal Shaheen Khan

filed an application under Order 22 Rule 10,

having acquired interest in the suit property by

purchase.

2. Accordingly, Shaheen Khan was substituted

in place of Shakil Ahmed but in the cause title

of judgment the name of Shakil Ahmed was

typed inadvertently as respondent in place and

stead of Saheen Khan.

3. Another typographical mistake has crept in

the second line of the first paragraph of the

judgment where Title Appeal No. 129 of 2017

has been written as 1296 of 2017.

4. This typographical mistakes be therefore

removed. The cause title of the judgment be

corrected. Server copy be also corrected

accordingly.
