Both the learned advocates appearing on behalf of the

appellant as well as on behalf of the State are present.

2. The application for condonation of delay is taken up

for hearing.

3. This is an application for condonation of delay of 16

days in filing this appeal.

4. Learned advocate appearing on behalf of the appellant

has referred paragraph 6 where the delay has been

explained. The delay is condoned.

5. Accordingly CRAN 1 of 2023 stands disposed of.

CRA (SB) 150 of 2023

6. This is an appeal against the judgment and order of

conviction of sole appellant, Sk. Abdus Salam @ Kalu

@ Sk. Salam, who was found guilty of committing

offence under Section 498A/306 of the Indian Penal

Code for which he was sentenced to suffer simple

imprisonment for a term of two years and also pay to

fine Rs.3000/-, in default, to suffer simple

imprisonment for another one month for the offence

under Section 498A of the Indian Penal Code. He was

also sentenced to suffer rigorous imprisonment for

seven years and also to pay fine of Rs.6000/-, in

default, to suffer rigorous imprisonment for another

two months for the offence punishable under Section

306 of the Indian Penal Code.

7. Heard learned counsel appearing on behalf appellant

and also I have perused the judgment.

8. The appeal is admitted.

9. Issue usual notice.

10. Trial Court Record be called for.

11. After arrival of the Lower Court Record, if it is

found, otherwise in order, the formal paper book shall

be prepared within six weeks thereafter.

12. Liberty is given to file application for suspension of

sentence.

13. Realization of fine amount be stayed in the

meantime.
