THE COURT: Learned Counsel for the decree-holder has submitted
that the execution proceeding has been filed within two years from getting the
decree. As per direction of this Court on 24th June, 2021 the decree-holder
effected service of notice upon the judgment debtor but they did not appear.
Thereafter, this matter did not come up for hearing.
After going through the records it appears that as the matter is an
old one and previously the decree-holder was directed to serve notice upon the
judgment debtor and thereafter more than two years have passed, I direct the
decree holder to serve a fresh notice upon the judgment debtor that the matter
will be taken up after seven days.
Let this matter come up on 29th November, 2023.
