The petitioner No.3/accused has expired during the pendency of
the case. Therefore, criminal case abates as against the petitioner
No.3. The remaining petitioners and the opposite parties have filed a
joint petition for compromise stating, inter alia, that the dispute
between the others has been amicably settled. After receiving the
application the learned P.P.-in-charge was directed to obtain a report
from the Officer-in-charge of Pandua P.S. The Officer-in-charge has
submitted a report admitting the fact that the dispute has been
amicably settled. The missing person returned his home and it was
ascertained that the accused persons were in no way connected with
the kidnapping/abduction of the victim.
In view of such circumstances, the instant compromise petition
is accepted.
In view of acceptance of the instant compromise petition, G.R.
Case No. 60 of 2008 is quashed.
The learned Chief Judicial Magistrate, Hooghly is directed to
pass a formal order dropping the G.R. Case No. 60 of 2008 and
discharging the accused from the case.
The instant revision and the connected application are disposed
of.
