Learned counsel who were appearing for the

parties have kindly consented to be present at the

request of the Court. This matter has been listed at the

instance of the Court. Counsel submits that the

petitioner who had appeared in-person yesterday was

informed that the matter would be listed today. The

petitioner however is not present in Court.

Although the matter was directed to be listed in

June, 2023 after the summer vacations of the Court,

this may be a fit matter where the parties concerned

can be referred to mediation. The Judgment of the

Supreme Court in Afcons Infrastructure Limited vs.

Cherian Varkey Construction Company Private Limited;

(2010) 8 SCC 24 permits such a matter to be referred to

mediation.

List this matter on 7th June, 2023.

Counsel are requested to inform the parties in

question of the returnable date. The private respondent

who is present in Court does not have any objection to

mediation. Counsel are requested to communicate this

order on the petitioner.
