This application relates to a prayer for setting aside

the order dated 3rd February, 2023 passed in connection

with Money Suit No.55 of 2018 whereby the learned Civil

Judge (Senior Division) at Sealdah passed an order for

hearing of the application under Order VII Rule 11 of the

Code of Civil Procedure to be adjudicated at the time of

passing the judgment in connection with Money Suit No.55

of 20178.

Considering the aforesaid facts and circumstances, I

find that contentious issue is required to be heard in

presence of both sides.

Accordingly, let there be a direction upon the

petitioner to serve notice along with a copy of this revisional

application upon the opposite party and its advocate-on-

record appearing in the Court of the learned Civil Judge

(Senior Division), Sealdah, by Speed Post with

Acknowledgement Due and file an affidavit-of-service on the

next returnable date.

Considering all the facts and circumstances, let

there be an order of stay of all further proceedings in

respect of Money Suit No.55 of 2018 for a limited period,

i.e., till the last week of April, 2023 or until further order

whichever is earlier.

Let the matter appear under the heading "Motion" in

the list on 10th April, 2023.
