The fundamental issue in this application under
Article 227 of the Constitution of India is a prayer for early
disposal of Title Appeal No.25 of 2014, pending before the
learned Additional District Judge, 2nd Court, Uluberia,
District - Howrah, whereby the judgment and decree dated
31st March, 2014 passed by the learned Civil Judge
(Junior Division), 1st Court at Uluberia, District - Howrah,
in Title Suit No.29 of 2006, was challenged.
As there is no contentious issue involved in this
application, service of notice upon the opposite parties is
not required. Thus, service of notice upon the opposite
parties is dispensed with.
The learned Additional District Judge, 2nd Court,
Uluberia, District - Howrah, is requested to dispose of the
Title Appeal No.25 of 2014, as expeditiously as possible,
without granting any unnecessary adjournment to either of
the parties in any case, unless extreme emergent ground
demands so.
Learned advocate appearing on behalf of the
petitioners is at liberty to communicate this order to the
learned Additional District Judge, 2nd Court, Uluberia,
District - Howrah, as well as the learned advocate
appearing on behalf of the opposite parties/defendants
before the learned Trial Court.
With the above observation, the revisional
application, being CO 6 of 2023, stands disposed of.
Urgent photostat certified copy of this order, if
applied for, be given to the parties, upon compliance of
necessary formalities.
