The challenge is directed against the order of

demolition dated 06.02.2023 passed by the Civil Judge

(Junior Division), Bidhannagar, 24 Parganas (North)

following the judgment passed in Municipal Appeal No.1

of 2018 directing demolition of the boundary wall.

The issue raised in the application needs to be

addressed in presence of both sides.

Therefore, let there be a direction upon the

petitioner to serve notice upon the opposite

parties/respondents and their learned advocate

appearing on behalf of the opposite parties before the

Trial Court, by speed post with A/D, and furnish

affidavit of service on the next returnable date.

In the meantime, let there be a direction of stay of

order dated 06.02.2023 passed by the Civil Judge

(Junior Division), Bidhannagar, 24 Parganas (North) for

a limited period of time, i.e. till 4th week of March, 2023.

List the matter on 27th March, 2023.

Learned advocate appearing on behalf of the

petitioner is at liberty to communicate this order to the

Chairman, North Dum Dum Municipality for compliance

forthwith.

All parties shall act on the server copy of this

application duly downloaded from the official website of

this court.
