The instant matter is listed on the mentioning made by
the learned advocate for the petitioner. It is clear from the order
dated 3rd August, 2022 that the petitioner is burdened with a
criminal case under the NDPS Act since 2003. Out of nine
witnesses four witnesses have already been examined and the
case is pending for examination of the remaining five witnesses.
It is submitted by the learned advocate for the petitioner
that the NDPS Case No.12 of 2003 is fixed for trial on 3 rd
February, 2023. The petitioner prays for a direction upon the
prosecution so that the remaining witnesses may be examined
within a short period of time.
The opposite party, Narcotics Control Bureau is directed to
produce at least three witnesses on the next date of hearing.
The petitioner is directed to send gist of this order to the
opposite party for compliance. Thereafter within one month the
learned trial Judge shall continue the hearing of the case by
examining the remaining witnesses and taking it to its logical
conclusion.
With the above order, nothing remains in the instant
revision. Accordingly, the instant revision is, thus, disposed of.
