The husband of the petitioner was an
Assistant Teacher of a Secondary School. On his
death his widow, the petitioner herein applied for
family pension. She has received family pension
and arrear pension. The petitioner by the instant
writ petition is praying interest on the arrear
pension on the ground of delay in disbursement.
The petitioner in support of her such claim relies a
judgment of the Division Bench of this Court
delivered on March 24, 2021 in the case of the
Director of Pension, Provident Fund & Group
Insurance & Anr. -Vs- Subhadra Pradhan & Ors.
The copy of the said judgment is annexed with the
writ petition.
The learned advocate for the State submits
that he requires some time to ascertain as to
whether the ratio laid down in the said judgment
is applicable in the present case or not.
In view of such submission of the said learned
advocate for the State, hearing of the writ petition is
adjourned.
Let the matter be listed again on February 6,
2023.
