The Court: On being mentioned by the learned counsel for the parties,

matter is treated as on Day's List subject to the consideration of the urgency as

well as non-availability of the regular Bench.

The police authorities have produced the judgment debtor no.3 namely,

Birendra Kumar Prasad pursuant to the execution of the Warrant of Arrest

issued on November 24, 2022 by a Co-ordinate Bench of this Court.

The judgment debtor undertakes to file Affidavit of Assets in course of

the week and on consideration of such undertaking the judgment debtor no.3

is released from the custody of the Court and Warrant of Arrest issued against

him is kept in abeyance for the time being.

However, it is made clear that the Warrant of Arrest issued against the

judgment debtor nos. 1 and 2 will be in subsistence.

The matter is made returnable on 17th February, 2023 before the regular

bench under the heading 'Examination of Judgment Debtor'.

The Deputy Sheriff is directed to comply with this order forthwith.
