The Court: According to learned counsel appearing for the
petitioner, the Collector of Stamp Revenue, Kolkata, has applied a rate of 7%
instead of 0.5%, which is the applicable rate, according to the petitioner.
Counsel relies on a judgment delivered by a Co-ordinate Bench in Dalgreen
Agro Pvt. Ltd. vs. State of West Bengal and Ors. on 3rd May, 2019. Counsel
also submits that the petitioner is ready to pay the applicable rate pending
decision in the appeal.
Learned counsel appearing for the State submits that the State
has challenged the said judgment in September, 2021 and that the appeal is
pending as on date.
List this matter on 20th March, 2023, as prayed for.
