This is an appeal against the order of acquittal under Section

256(1) of the Code of Criminal Procedure just for non-appearance on

the day fixed for show cause by the complainant. By the order

impugned, the accused person was discharged from the bail bonds.

2. Having heard the learned advocate on behalf of the appellant on

the ground of appeal and also having gone through the judgment

impugned, I allow the instant application for special leave to appeal.

3. The appellant is at liberty to prefer an appeal within the

statutory period.

4. With the aforesaid observation, CRMSPL 71 of 2023 stands

disposed of.

5. Criminal Section is directed to supply certified copy of this order,

if applied for, upon compliance of necessary formalities.
