The Court : Affidavit of Service filed by the award-holder be kept with the
records.
Despite service, the judgment-debtors are not represented.
This is an application for execution of an award dated 27th November,
2017 for an amount of Rs.10,20,093/-. It is submitted on behalf of the award-
holder that there is no embargo in proceeding with this execution petition and
the award has attained finality. Repeated orders have been passed from time to
time. The award-debtors were also directed to file their Affidavit of Assets. No
Affidavit of Assets have been filed till date.
In such circumstances, let there be a warrant of arrest against the
judgment-debtor no. 3.
The Officer-in-Charge of the concerned Police Station having jurisdiction
as well as the Superintendent of Police are directed to ensure compliance with
the aforesaid order and produce the judgment-debtor no. 3 on or before the
returnable date.
Let this matter appear in the Monthly List of January , 2024.
