By the impugned judgment and order an award
dated 3rd April, 2017 passed by the District Magistrate,
North 24-Pargans has been set aside.
We admit this appeal under Section 37 of the
Arbitration and Conciliation Act, 1996.
There is no scope of any interim order. We
expedite hearing of the appeal dispensing with all
formalities.
Since the respondents have appeared, issuance
and service of the notice of appeal is waived.
Transmission of lower court record is dispensed
with for the time being. We may call for those records if
required at the time of hearing of the appeal.
Advocate-on-record for the appellants will
prepare an informal paper book and file the same
in this Court by 29th September, 2023 serving a copy
thereof on the advocate-on-record for the
respondents at least seven days before the date fixed for
hearing of the appeal.
List the appeal for hearing on 12th October,
2023.
The connected application (CAN 1 of 2023) is
disposed of.
As affidavits were not invited to the application
the allegations contained therein are deemed not to
have been admitted.
