This appeal preferred assailing the judgment and
order dated 18th July, 2023, whereby learned Additional
Session Judge, Tehatta, Nadia found the
appellant/accused guilty of committing offence under
Sections 448/354 of the Indian Penal Code and
sentenced to suffer simple imprisonment for three
months and to pay fine of Rs.500/-, in default to suffer
simple imprisonment for one month for the offence under
Section 448 of the Indian Penal Code and he was also
sentenced to suffer simple imprisonment for one year and
to pay fine of Rs.5000/-, in default, to suffer simple
imprisonment for six months for the offence under
Section 354 of the Indian Penal Code.
Having heard the learned counsel appearing on
behalf of the appellant and also considering the judgment
impugned, I find that there is scope for re evaluation of
evidence. The appeal is admitted. Issue usual notices.
Trial Court Record be called for.
After arrival of the Lower Court Record, if it is
found, otherwise in order, the formal paper book shall be
prepared within six weeks thereafter.
Liberty is given to file application for suspension of
sentence.
Realization of fine amount be stayed in the
meantime.
