By a judgment and order dated July 7, 2023, we
directed the respondent no 2 to submit a report with regard
to the claim for compassionate appointment made by the
petitioner including his financial eligibility with regard
thereto in terms of relevant notification.
Learned Senior Advocate appearing for the State
submits a writing dated July 27, 2023 by which, the claim
for compassionate appointment of the writ petitioner was
negated.
Learned Advocate appearing for the writ petitioner
submits that, the financial criteria calculations are
incorrect. Moreover, such circulations were not in
accordance with the judgment and order dated July 7,
2023.
Since, the authorities rejected the prayer for
compassionate appointment on the ground of non-fulfilment
of the financial criteria, it would be appropriate to permit
the petitioner herein to assail such rejection before an
appropriate forum in accordance with law.
All points raised by the parties are kept open.
WP.ST 4 of 2014 is disposed of accordingly.
