The Court : This is an application inter alia under the principles

analogous to Section 10 of the Code of Civil Procedure, 1908 (in short CPC)

for stay of the suit made by the sole defendant. The defendant's application

under Order 7 Rule 11 of CPC has been heard and judgment has been

reserved therein.

In such circumstances, let this matter go out of the list for the time

being with liberty to the parties to mention the matter after the judgment in

the application under 7 Rule 11 of CPC is delivered.
