Mr. Milan Ch. Bhattacharjee, Ld. Sr. Adv.,
Ms. Sulagna Bhattacharya, Adv.
...for the appellant/
writ petitioner.
Md. T.M. Siddiqui, Ld. AGP,
Mr. N. Chatterjee, Adv.,
Mr. D. Gomes, Adv.
...for the State.
The appellant's writ petition was dismissed by the
impugned judgment and order. Having heard Mr.
Bhattacharjee, learned Senior Advocate appearing for
the appellant/writ petitioner, we are of the view that
instead of having multiple hearings, we should hear out
the appeal.
We are told that all papers that were there before
the learned Single Judge have been annexed to the stay
petition. On the basis of such papers, we propose to hear
out the appeal. All formalities including the filing of
paper books are dispensed with. Since the respondents
are represented, notice of appeal is deemed to have been
waived.
List the appeal and the connected stay application
under the heading 'Hearing' within the first three items
on November 23, 2022.
